Intellectual Property Rights Policy

Definitions
"Content" means all photography, video, written work, designs, and physical or digital products created or published by Tajinder Kaur ("the Photographer," "I," "me") including prints, zines, stickers, and newsletter content.
"User," "you," or “client” refers to any individual or entity accessing or purchasing our Content.
This policy should be read alongside the Terms & Conditions published at https://www.tajinderkaur.co.uk/terms-and-conditions, which governs payment, delivery, and the working relationship between Photographer and Client. Where a signed contract specifies usage rights that differ from the tiers set out below, the signed contract takes precedence for that engagement.
Copyright Protection and Ownership
In accordance with the Copyright, Designs and Patents Act 1988, copyright in all Content created by the Photographer is owned by the Photographer. The entire copyright in the Content is retained by the Photographer, at all times, throughout the world.
If the Client wishes to own the copyright of Content created by the Photographer, an additional fee will be paid by the Client to the Photographer for transferring the copyright. This fee will be mutually agreed by both parties. The transfer of copyright will only be applicable after the payment has been made in full.
All Content is automatically protected under the UK Copyright, Designs and Patents Act 1988, including:
Photographs and digital image files, in both raw and edited form
Video and motion content
Written work, including newsletter and Substack content
Print, zine, and sticker designs, including quote text
Retouched or composited versions of any image
Behind-the-scenes and outtake material not selected as final Deliverables
Branding, graphics or designs
No formal registration is required for this protection - our rights exist from the moment of creation and is valid for 70 years after our death.
Unauthorised reproduction, distribution, modification, or use of any material without prior written consent is strictly prohibited.
Informal or Unpaid Collaborations
This section governs image/video delivery and credit only. Where the arrangement was intended as paid work, standard Fees and payment terms under Terms & Conditions (1.13) still apply regardless of whether a written agreement was signed.
Where a collaboration is undertaken without a signed written agreement between the Photographer and Client, including where the arrangement is made verbally, or via text message, direct message, or other social media correspondence, or where the collaboration is unpaid, the following terms apply automatically, regardless of any prior informal understanding between the parties:
Deliverables are limited to a maximum of fifteen (15) final images/videos, irrespective of the number of images captured, requested, or previewed
The Photographer must be credited by name, plus @thetajinderkaur where the platform supports tagging. in any use of the images, whether shared digitally, in print, or in motion/video content, across any platform or medium
Copyright in all images and videos remains with the Photographer at all times, as set out above
These terms take effect upon delivery of the images/videos and are not contingent on further written confirmation from either party
PERMISSIBLE Usage Rights & Licensing
As a client, you may:
Use the Content to market yourself or your business as agreed upon in the contract signed and dated by the client
Share images online and on social media platforms only when proper credit is given by tagging the photographer and linking back to this Site where applicable
View images on this Site for personal inspiration or reference
Different licensing packages for delivered Content
TIER 1: ORGANIC USE (INCLUDED AS STANDARD)
Personal or brand social accounts, organic (non-paid) posts only. Does not cover paid promotion, website use, or press.
TIER 2: PAID SOCIAL / BOOSTED USE
Covers everything in Tier 1, plus use in paid social advertising and boosted posts on the same platforms. Included in the Story and Platform retainer tiers; available as a +£150/month add-on on Presence and single sessions.
TIER 3: FULL USAGE
Covers everything in Tier 2, plus website use, press and PR use, and internal partnership or whitelisting placements. Included in the Platform retainer tier; available as a +£350/month add-on elsewhere.
DURATION
Usage rights apply for as long as the agreement is active. Content already published under a given tier keeps that licence indefinitely, usage does not retroactively upgrade or downgrade if the agreement later changes.
OWNERSHIP
Tajinder Kaur retains copyright and portfolio rights to all delivered images and video, including the right to use the work, edited or unedited, in her own portfolio, website, and marketing, unless otherwise agreed in writing.
UPGRADING AFTER DELIVERY
A usage tier can be upgraded on already-delivered content, contact for pricing specific to that content.
SUBJECT CONSENT
For photography and content Services booked under a signed contract, where individuals appear in the content, their consent is covered separately under the Model & Event Release Form. This governs what the Client may do with the footage; the release form governs what was agreed with the people in it.
For events and workshops, attendance itself constitutes consent to being photographed or filmed for the Photographer's portfolio, marketing, and social channels, as set out in the Terms & Conditions (4.3). Anyone who doesn't want to be included can say so on arrival, and will be excluded from published content on that basis.
Strict No-Distribution Policy
The following commercial activities are strictly prohibited under UK law:
Selling or reselling any part of the Content, except for the resale of a physical product in its original, unaltered form
Charging others to access the Content
Using the Content to create paid products or courses
Monetising the Content in any way
Creating derivative works for commercial gain
Distributing the Content as part of paid programs or services
Zero Tolerance for Profit from Distribution
We maintain a strict zero-tolerance policy for:
Any attempt to profit from our Content through distribution
Using our Content in paid membership sites or programmes
Selling access to our materials in any form
Creating revenue-generating products based on our Content

Available Remedies
Under UK law, we can:
Seek damages for copyright infringement
Obtain court orders to stop unauthorised use
Recover legal costs from infringers
Criminal proceedings under the Copyright, Designs and Patents Act 1988 apply to commercial-scale infringement, counterfeiting or organised piracy, and are pursued by UK authorities, not the Photographer directly. A single unauthorised repost or misuse is handled through the civil remedies above.
